In light of the public interest concerns involved, Unified Patents is seeking prior art or other grounds of invalidity for claim 1 of US US 10,533,994 B2, which has been asserted by non-practicing entity Labrador Diagnostics, LLC, a NPE owned by Fortress Investment Group. The patents were originally owned by Theranos, the now-defunct diagnostics company run by Elizabeth Holmes—here listed as the lead inventor. The '994 patent purport to cover "portable medical devices that allow real-time detection of analytes from a biological fluid." Labrador has asserted these patents in U.S. district court against BioFire Diagnostics, LLC and bioMerieux S.A. and has sought an injunction to prevent them from making, selling, or using their testing kits.
